Illegal Use
Bengalwebhosting services may be used for lawful purposes only. Transmission, storage or distribution of any information, data or material in violation of any applicable law or regulation or that may directly facilitate the violation of any particular law or regulation is prohibited. This includes, but is not limited to: copyrighted material; trademarks; trade secrets, or other intellectual property rights used without proper authorization; material that is obscene, defamatory, constitutes an illegal threat or violates export control laws.
System and Network Abuse
Violations of system or network security are prohibited and may result in criminal and civil liability. Examples of system or network security violations include, without limitation the following: unauthorized access to or use of data, systems, or networks; interference with service to any user, host, or network including, without limitation, mail bombing, flooding, deliberate attempts to overload a system and broadcast attacks; forging of any TCP-IP packet header or any part of the header information in an email or a newsgroup posting.
Viruses and Other Destructive Activities
Use of Bengalwebhosting’s services or equipment for creating or sending Internet viruses, worms or Trojan horses, or for pinging, flooding or mail bombing, or engaging in denial of service attacks is prohibited.
Payment & refund
Bengalwebhosting reserves the right to suspend the services if the payments are not made by the due date. Bengalwebhosting shall not be held liable for any kind of loss due to the disruption of services.
1.All charges payable by you for the Services shall be in accordance with the scale of charges and rates published from time to time by us on our web site and shall be due and payable in advance of our service provision. We reserve the right to change pricing at any time although all pricing is guaranteed for the period of pre-payment.
2. Payment is due each anniversary month, quarter, or year following the date the Services were established until closure notice is given. If you choose to pay by credit or debit card you authorize Bengalwebhosting to debit your account renewal fees from your card.
3.All payments must be in US Dollars.
4. If your check is returned by the bank as unpaid for any reason, you will be liable for a “returned check” charge of $45.
5. Without prejudice to our other rights and remedies under this Agreement, if any sum payable is not paid on or before the due date, we shall be entitled forthwith to suspend the provision of Services to you.
Refunded
6.In 7 days money will be fully refunded . if you purchase, Unlimited plan or Combo plan then a refund within 7 days will be initiated with deducting the domain charges and ssl charges. After 7 days no refund will be initiate except an unlimited plan. In unlimited plan refund after 7 days will be along with deduction of domain and usage per month.
Actions Taken by Bengalwebhosting
The failure by a customer to meet or follow any of the TOU is grounds for account deactivation. Bengalwebhosting will be the sole arbiter as to what constitutes a violation of the TOU. Bengalwebhosting reserves the right to remove any account without prior notice and to refuse service to anyone at any time. Depending on the severity of the violation, Bengalwebhosting may, at its sole discretion, restrict, suspend, or terminate a customer’s web hosting account and/or pursue other civil remedies. If such violation is a criminal offense, Bengalwebhosting will notify the appropriate law enforcement authorities of such violation. Bengalwebhosting does not issue credits for outages incurred through service disablement resulting from TOU violations. Bengalwebhosting customers agree to indemnify and hold harmless Bengalwebhosting from any claims resulting from the use of our services that damages them or any other party.
IRC
Bengalwebhosting does not allow IRC or IRC bots to be operated by Web Hosting and E-Commerce customers.
Anti Piracy
Bengalwebhosting’s Web Hosting and E-Commerce accounts should not be used to distribute illegal or pirated software and/or multimedia products.
The Bengalwebhosting service is provided on an as-is, as available basis without warranties of any kind, either express or implied, including, but not limited to, warranties of merchantability, fitness for a particular purpose, or non-infringement. Bengalwebhosting and its partners and suppliers will not be liable for any cost or damage arising either directly or indirectly from any transaction or use of the service.
Income Disclaimer
Bengalwebhosting strictly prohibits its Partners from publicly disclosing their own earnings because no one person’s income is typical but does show what is possible with time, effort, and dedication.
What you earn as an Bengalwebhosting partner is wholly determined by your own individual efforts. Bengalwebhosting does not guarantee that any partners will earn any amount of income or any income at all from the promotion of our program.
The amount of time and/or money you invest in your business will determine your success.
– Back up restoration will be chargeable.
Restoration charges will be 1699 INR /-. If you paid for the restoration and backup will not
available in that case, the paid amount will be fully refunded. if the backup will available no refund
initiate. After a request for back up, you need to wait for 24-48 hours. We undertake periodic backups
of data on our shared hosting servers, but the final responsibility for all backups of the data on
your hosting packages rests with you. We strongly recommend that you take periodic backups and
store them at your end so that you have multiple options in case of necessity for a restore.
You may request us for a backup of the last 7 days (from the date of request) and in most cases, we will be able to provision this from our disaster recovery backups. However, this is not a part of our core hosting services and is merely a last resort. We will try our best to help you out but backups provisioning and restoration is an extremely time and resource-intensive process and hence we can only promise a best-effort service in this regard.
From the list of backups available and their date of generation, you must select the date of the back up very carefully as we will only be able to undertake this task once a week. Also, there may be a possibility of missing files due to the time elapsed between the date of backup and request for restoration, in such a case we will not be able to re-generate the backup.
If any account found in any kind of illegal activity, hacking, copyright issues, bot sites, adult contents such accounts will be suspended and terminated within 24 hours and no refund will initiate in such cases. Bengalwebhosting will not responsible in such cases for any kind of data loss.
I would request you to look into the following points regarding our backup policy:-
1) We do not promise the customers for providing the backups.
2) We take the backups on a rotational basis and we keep the incremental backups for the last 7 days as an additional service. Also, this is for our purpose and it is not compulsory.
3) So we always recommend the customers to take the backups of their site contents, databases, and emails at their end.
